Article 1. DEFINITIONS

For the purposes of these Terms, all the following terms, with a capital letter, have the meaning indicated below and apply both in the singular and plural:

Data: Any element (information, texts, photographs, messages, etc.) collected by the User and implemented by them on the Site, and Services where applicable, through their use;

Feature: Each element implemented, accessible and usable within the Site and Services through their use;

Operator: Company that operates various electronic telecommunications networks necessary for access to and use of the Site and Services where applicable;

Parties: Parties who have accepted and adhere to the Terms and the obligations they contain;

Third Party: Means natural or legal persons who are not linked by common ownership or control to Zeyno Solutions B.V. or other individuals with no relationship to Zeyno Solutions B.V. and/or the User.

User or "You": any person using or having access to the Site.

Article 2. PURPOSE OF THE TERMS

The purpose of these Terms is to define the conditions and methods of use of the Site.

The User declares by accessing and using the Site that they have read the Terms and accept them without reservation.

These Terms may be modified at any time by Zeyno Solutions B.V.. The Terms applicable to the user are those in force on the day they use the Site.

Article 5. ACCESS TO THE SITE

Access to and use of the Site are reserved for strictly personal use. You agree not to use this Site and the information or data contained therein for commercial, political, advertising purposes and for any form of commercial solicitation, including the sending of unsolicited emails.

The Site is accessible and usable twenty-four hours a day (24/7) and seven days a week (7/7), provided you have a computer terminal allowing connection to the internet network and internet access.

The Site is freely accessible to anyone with internet access. All costs relating to access, whether hardware, software or internet access costs, are exclusively your responsibility.

We reserve the right to refuse access to the Site to any user who does not comply with these Terms.

We implement all reasonable means at our disposal to ensure quality access to the Site.

We reserve the right to interrupt, temporarily suspend or modify without notice access to all or part of the Site, in order to carry out maintenance, updates, or for any other legitimate reason, without the interruption giving rise to any obligation or compensation.

Article 6. RESPONSIBILITIES

The responsibility of Zeyno Solutions B.V., in its capacity as publisher, cannot be engaged in the event of failure, breakdown, difficulty or interruption in the operation of the network or servers or any other event beyond the reasonable control of Zeyno Solutions B.V., preventing access to the Site or one of its features.

You are solely responsible for your equipment for connecting to the Site, the proper functioning of your computer equipment and your internet access. You must take all appropriate measures to protect your equipment and your own data, particularly from viral attacks via the Internet. You are also solely responsible for the sites and data you consult.

Zeyno Solutions B.V. cannot be held responsible in the event of legal action against you due to your use of the Site or any service accessible via the Internet and/or due to your non-compliance with these Terms.

Zeyno Solutions B.V. is not responsible for damage caused to yourself, third parties and/or your equipment due to your connection or use of the Site.

Article 7. INTELLECTUAL PROPERTY

Trademarks, photographs, texts, comments, illustrations, animated or still images, video sequences, sounds and all computer applications that could be used to operate this Site and, more generally, all elements reproduced or used on the Site, are protected by laws in force regarding intellectual property.

They are the full and entire property of Zeyno Solutions B.V. or its partners. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of Zeyno Solutions B.V., is strictly prohibited.

The fact that Zeyno Solutions B.V. does not initiate proceedings as soon as it becomes aware of these unauthorized uses does not constitute acceptance of said uses and waiver of prosecution.

Subject to the foregoing, in the event that the User transmits to Zeyno Solutions B.V. or uploads to the Site content, including photographs, texts, videos, illustrations (hereinafter the "Content"), the User grants Zeyno Solutions B.V. a non-exclusive, transferable, sub-licensable right of exploitation, free of charge, worldwide on all of this Content as it is published on the Site as well as a license on all intellectual property rights relating to the Content, for the entire legal duration of their intellectual property rights and worldwide.

The rights thus granted include the right to reproduce, represent, distribute, adapt, modify all or part of the Content by any means, in any form whatsoever and on any medium, for commercial or non-commercial purposes and in particular advertising.

Article 8. HYPERLINKS

Any information accessible via a link to other sites that it does not publish is not under the control of Zeyno Solutions B.V., which disclaims all responsibility for their content. Links on the Site directing you to other websites and/or providing access to information accessible on these sites do not engage the responsibility of Zeyno Solutions B.V..

The establishment by you of any hyperlinks to all or part of the Site is strictly prohibited, except with the prior written authorization of Zeyno Solutions B.V., requested by email at the following address: contact@zeyno-solutions.com

Zeyno Solutions B.V. is free to refuse this authorization without having to justify its decision in any way whatsoever. In the event that Zeyno Solutions B.V. grants its authorization, this is in any event only temporary and may be withdrawn at any time, without obligation of justification on the part of Zeyno Solutions B.V..

The user declares that the information they transmit to Zeyno Solutions B.V. is accurate and sincere. Any inaccuracy in the User's declarations is likely to engage their responsibility.

The use of the Site is reserved for adults with legal capacity. The user therefore guarantees that they are of age and have legal capacity.

The User agrees not to use the Site for any commercial purposes.

Article 12. FORCE MAJEURE

The Parties cannot be held responsible if the non-performance or delay in the performance of any of their obligations, as described herein, results from a case of force majeure, within the meaning of Article 1218 of the Civil Code.

Article 13. LANGUAGE

These Terms are written in French. They are also available in English. In case of difficulty, the French version prevails over the English version.

Article 14. APPLICABLE LAW

These Terms are governed by Dutch law.

Article 15. COMPLAINT AND AMICABLE SETTLEMENT OF DISPUTES

Article 16. COMPETENT JURISDICTION

All disputes to which these Terms could give rise, concerning their validity, interpretation, execution, resolution, their consequences and their effects, and which have not been the subject of an amicable settlement, will be submitted to the competent court under the conditions of common law.
